Manila, Philippines - The Department of Justice (DOJ) has cleared the complaint filed against alleged top Drug Lords Peter Lim and Kerwin Espinosa and 20 others due to lack of evidence and support. 

"Our law enforcement agencies shall gather more concrete and competent evidence proving that respondents and other individuals are indeed involved in illegal drug activities," the DOJ resolution read.

In a resolution obtained by the media on Monday, March 12, the panel of prosecutors recommended the dismissal of the charges for violation of Section 26 (b) (conspiracy) in relation to Section 5 (sale) of Republic Act 9165 or the Comprehensie Dangerous Drugs Act of 2002 filed against the two suspected drug lords. The panel ruled that the evidence submitted against the two was hearsay.

Other drug suspects who were cleared also were includes Peter Co, Marcelo Adorco, Max Miro, Lovely Impal, Ruel Malindangan, Jun Pepito, Jermy Amang and several others identified only by their aliases.

Adorco is named in the DOJ resolution as the only witness of the CIDG-MICU.

Adorco's testimony stemming from his arrest in a drug bust by elements of the PNP Albuera Leyte in June 2012 was used against Espinosa and Lim.

Adorco was arrested during the buy bust operation in July 2016 it has also issued an affidavits with the activities with Espinosa, Co, Lim and Impal. 

On the three affidavits issued last year it was told how he became a close confidante of the Espinonas after a meeting with Kerwin in prison last 2011. 

He said he then became a bodyguard/driver of the Espinosas. He had a notebook in which has contained the list of people who had an illegal transactions as well with the people whom they provided illegal firearms these were delivered and transported to Bohol, Samar, Northern and Southern Leyte, Biliran and some parts of Cebu.

The complaint against Lim and Espinosa was filed by the Philippine National Police- Criminal Investigation and Detection Group- Major Crimes Investigation Unit (PNP-CIDG-MCIU).

It added, "For an evidence to be believed, it must proceed not only from the mouth of a credible witness but must be credible in itself as to hurdle the test of conformity with the knowledge and common experience of mankind."

In the resolution, Assistant State Prosecutors Michael John Humarang and Aristotle Reyes said the testimony of Adorco has no probable value as it is just hearsay. 

The Resolution said that Adorco only overheard the conversation via telephone regarding the drug supplies allegedly it will come from Peter Lim or Peter Co. 

It is well-settled under the rules on evidence that hearsay cannot be given credence and has no probable value at all," it added.
